This policy (the “Privacy Policy”) describes how Evermore Games LLC (as defined below) collects and uses personal information from users across various platforms, including https://www.evermorearcade.com and https://evermoregamesllc.com,   mobile sites, services, applications, and platforms, if any,  operated by Evermore Games LLC where this Privacy Policy is featured or referenced, or from third parties, or where no separate Privacy Policy is provided (collectively, the “Sites”). Please read this Privacy Policy carefully, as it applies each time a user accesses the Sites and uses their services. By using and accessing the Sites, you accept the terms of this Privacy Policy.  

Information About Us

The Sites are operated by Evermore Games LLC, with an address at 111 South Street #201, Oyster Bay NY 11771 (“Evermore” or “We”). The words “user”, “you” and “your” in this Privacy Policy refer to a user of the Sites.

Our Sites are not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. No one under age 18 may provide any information to or on the Sites or on or through any of its features. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. We are committed to protecting and respecting your privacy. This Privacy Notice applies where we process personal information as a ‘data controller’ under applicable data protection legislation. These are instances where we decide the purpose for which (i.e. why) personal information is processed. This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide to us, or we collect automatically through our services or from other sources or from third parties such as social media sites, will be processed by us. By accessing or using our Sites, you agree to the practices described in this Privacy Policy in accordance with applicable legislation. This Policy is prepared in compliance with the requirements of Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5, the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the UK General Data Protection Regulation (Council regulation 2016/679 (2016)(“UK GDPR”),  and local, state, and federal laws of the US as in force from time to time. Protecting your personal privacy is very important to us at Evermore. Below you will find a statement of our commitment to ensuring the privacy of your personal information. “Personal data/information” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, business address, EIN number, or payment information (for example, account information such as name, postal address, and email address, or information collected directly by us or our payment processor,  or any other identifier we may use to contact you online or offline. This Privacy Policy statement applies to the Sites and all our other communications and data processing platforms.

Information We Collect

The types and categories of personal data we collect or process include:

·             Account and contact information, including name, address (such as home address, work address, or other address), email address, phone number, and other contact information you provide to us.

·             Through our third-party payment processor, payment information, including information about payment methods and services (such as wire transfer, PayPal, Stripe, or other means), you direct us or our payment processor to use in connection with your collection of your funds from participating in the games hosted on the Sites. 

·             Location information, including general geographic location such as country, state or province, or city, and precise geolocation, if you have enabled and consented to location information collection.

·             Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.

Some of the information identified above, including precise geolocation information) may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with the requested features, services, or information.

The sources of personal data we collect include:

  • Information you provide to us. Information provided by creating an account on the Sites, contacting us through the Sites, or via email, including your name, address, email address, phone number, and payment information collected by our third-party payment processor.
  • Automatically collected information. When you access our Sites, some information not associated with specific users, such as device type, location information, IP address, webpage traffic, and access time is automatically collected to ensure the Sites’ functionality.
  • From third-party sources. We may collect information from third parties to whom you have provided your information.

We obtain personal information when you provide it to us via:

  • Electronic or written responses to letters, mailings, and other means of communication. We may record emails and other correspondence if you contact us, for quality assurance purposes.
  • While providing our services to you, for instance, when you become a registered user of the Sites. To become a registered user of our Sites, you will need to share some personal information, such as your legal name, email address, and confirmation that you are 18 or over. Once you register, you will have an account with us and a password to access that account.
  • Certain content submissions, community postings (i.e., chats or bulletin boards), or comments and suggestions.
  • Your responses to surveys that we might ask you to complete for research or marketing purposes.
  • Your use of our Sites, including your browser type or the Internet Protocol (“IP”) address used to connect your computer to the Internet.
  • Your use of our Sites, such as which pages you visited most often, and which games or tournaments are of most interest. We may also track which pages you visit when you click on links in emails. We may use this information to personalize the way our Sites are presented when you visit them, to make improvements to our Sites, and to ensure that we provide the best service for users.
  • If you win $600.00 (six hundred dollars or more), to issue an IRS 1099 form to you for that calendar year, we will collect your legal name, Tax Identification Number (“TIN”), residence address, account information, and the total amount paid to you during the tax year.

We also collect:

·  Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific game or tournament, or for marketing purposes.

·   Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Sites, such as clickstream information to, through, and from our Sites (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

How We Use Information

If you are based in Canada, the EU or the UK, we will only use your personal information for electronic marketing purposes if we are allowed to do this by law or if we have your consent. If you agree to us providing you with marketing information, you can always opt out later. Evermore may share your personal information with companies that are related to or affiliated with Evermore (collectively, “Affiliates”). Affiliates will use your personal information in accordance with the terms of this Privacy Policy.

For How Long Do We Keep Your Personal Information and Storage
We will retain your personal information as long as necessary to provide the products or services you have requested, or to otherwise achieve the purpose for which the personal information was collected and processed. Typically, information is retained for the duration of any contractual relationship, or for as long as the information is required for other legitimate business purposes such as resolving disputes, complying with our legal obligations, and enforcing our agreements, or as permitted by applicable law. As the purpose for processing the personal information can vary, the retention period for different categories of personal information can also vary. We determine our retention periods in accordance with legal and operational requirements. Children

Our Sites are not directed at children, and we do not use our Sites to knowingly solicit personal information from or market to children. If we learn that a child has provided personal information through one of our Sites, we will remove that information from our systems.

Your US State Privacy Rights, including California Privacy Rights
US state consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California residents may also request that certain information be deleted, but exceptions apply. Some browsers and browser extensions support Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

From time to time, we may send you emails, product updates, customer satisfaction surveys, invites for webinars, or any other forms of communication containing marketing communications. If we process your personal information to send you marketing communications and you no longer wish to receive these communications, you may opt out at any time. ·   Google Remarketing Technology: Our Sites may use Google’s remarketing technology. This technology enables users who have already visited our online services and shown interest in our services to see targeted advertising on the websites of the Google partner network. Likewise, users that are like the visitors of our Sites can be served an advertisement. The information generated by the cookie about the website use will be transmitted to and stored on servers in the United States by Google. If the IP address is transferred, it will be reduced by the last 3 digits. Using cookies, the user behavior on a website can be analyzed and subsequently utilized to provide targeted product recommendations and advertising based on the user’s interests. ·    Facebook Conversion Tracking: Our Sites may utilize the Conversion Tracking Pixel service of Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA (“Facebook”). This tool allows us to track user actions after they are redirected to a provider’s website by clicking on a Facebook advertisement. We are thus able to record the efficacy of Facebook and Instagram advertisements for statistical and market research purposes. While we cannot see the personal data of any individual user, the collected data is saved and processed by Facebook and Instagram. Facebook and Instagram can connect the data with your Facebook and Instagram account and use the data for their own advertising purposes, in accordance             with   Facebook’s  Data  Use  Policy  found under: https://www.facebook.com/about/privacy/. Facebook Conversion Tracking also allows Facebook, Instagram, and their partners to show you advertisements on and outside Facebook and Instagram. Security
We apply appropriate technical, physical, and organizational measures that are reasonably designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access, and against other unlawful forms of processing.   • Firebase App Check for attestation
  • Firestore IAM and role-based access controls
  • Realtime logging and monitoring
  • Regular vulnerability scans and secure coding practices
  • Periodic security reviews and audits

Hyperlinked Sites
No hyperlinking is permitted to the Sites without the express written permission of Evermore.

Wireless Communications
If the email address you provide to Evermore is a wireless address, you agree to receive messages at such address from Evermore. You understand that your wireless carrier’s standard rates apply to these messages. You represent and warrant that you are the owner or authorized user of the wireless device on which messages will be received, and that you are authorized to approve the applicable charges associated therewith.

Intellectual Property
Your use of the Sites does not give you permission to use any of Evermore’s names, logos, designs, slogans, product trademarks or service marks (“Evermore’s Marks”) in any manner, or to use Evermore’s Marks or any other words or codes in any “metatag” or to use other information location tools to identify and select sites, without Evermore’s express written permission for a particular use.

Severability
If any provision of this Privacy Policy is found to be illegal, void, or unenforceable, that provision will be deemed severed from the balance of the agreement and will not affect the validity and enforceability of the remaining provisions, which will continue in full force and effect.

Revisions
Evermore may, at its sole discretion, revise this Privacy Policy at any time in a manner consistent with applicable laws and regulations. When we revise this Policy, including changes to Evermore’s use of your personal information, we will incorporate the revisions into this Policy and will revise the “last revised” date at the top of this web page.
